Acceptance of Terms

By accessing and using the services of aerflow B.V., including our website and renovation services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms constitute a legally binding agreement between you and aerflow B.V., a company registered in the Netherlands under registration number 51982064.

Company Information

aerflow B.V. is a renovation services company incorporated under Dutch law. Our registered office is located at Eikenlaan 52, 4828 XK Breda, North Brabant, Netherlands. We are registered with the Dutch Chamber of Commerce under number 51982064 and hold VAT number NL836150927B01. We provide professional renovation services throughout the Netherlands, with a primary focus on the North Brabant region.

Services Description

aerflow provides comprehensive renovation services including but not limited to kitchen renovations, bathroom renovations, interior design and renovation, home extensions, general construction work, and related consultation services. All services are provided in accordance with Dutch building codes and industry standards. Specific project details, timelines, and costs will be outlined in individual project contracts.

Project Contracts and Quotes

All renovation projects require a written contract signed by both parties. Quotes provided by aerflow are valid for 30 days unless otherwise specified. Project contracts will include detailed specifications, timelines, payment schedules, and terms specific to your renovation project. Any changes to the original scope of work must be agreed upon in writing and may affect the project cost and timeline.

Payment Terms

Payment terms will be specified in individual project contracts. Generally, we require a deposit before work commences, with progress payments due at specified milestones, and final payment upon project completion. All payments must be made in Euros. Late payments may incur interest charges as permitted by Dutch law. We reserve the right to suspend work if payments are not made according to the agreed schedule.

Client Obligations

Clients are responsible for providing accurate information about their renovation requirements, obtaining necessary permissions from landlords or property management companies where applicable, ensuring site access during agreed working hours, maintaining insurance coverage for their property during renovation work, and making timely payments according to the contract terms. Clients must also ensure that any existing utilities are properly marked and accessible.

Permits and Approvals

While aerflow can assist with permit applications and regulatory approvals, the ultimate responsibility for obtaining necessary permits lies with the property owner. We will advise on permit requirements and can facilitate the application process, but we cannot guarantee permit approval or be held liable for delays caused by permit processing. Additional costs for permit applications and professional consultations will be outlined in the project contract.

Warranties and Guarantees

aerflow provides a warranty on workmanship for a period of two (2) years from project completion. This warranty covers defects in our workmanship but does not extend to normal wear and tear, damage caused by misuse, or issues arising from materials specified by the client. Manufacturer warranties on materials and fixtures are passed through to the client. Any warranty claims must be reported promptly and in writing.

Intellectual Property

All designs, plans, specifications, and other intellectual property created by aerflow remain the property of aerflow B.V. unless otherwise agreed in writing. Clients receive a license to use these materials for the specific renovation project. The aerflow name, logo, and branding are registered trademarks and may not be used without express written permission. Clients may not reproduce or distribute our proprietary designs or methodologies.

Limitation of Liability

To the maximum extent permitted by Dutch law, aerflow's total liability for any claims arising from our services shall not exceed the total amount paid by the client for the specific project giving rise to the claim. We shall not be liable for indirect, consequential, or punitive damages, including but not limited to loss of profits, business interruption, or temporary accommodation costs. This limitation applies regardless of the legal theory upon which the claim is based.

Force Majeure

aerflow shall not be liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, labor disputes, material shortages, or other unforeseeable events. In such cases, we will notify clients promptly and work to minimize delays and additional costs.

Termination

Either party may terminate a project contract under the conditions specified in the individual contract. Generally, termination requires written notice and may result in charges for work completed and materials ordered. aerflow reserves the right to terminate services immediately if clients breach payment terms or other material contract provisions. Upon termination, clients remain responsible for payment of all work completed and costs incurred up to the termination date.

Privacy and Data Protection

aerflow is committed to protecting client privacy and personal data in accordance with the General Data Protection Regulation (GDPR) and Dutch privacy laws. Our collection, use, and protection of personal information is detailed in our Privacy Policy, which forms part of these terms. By using our services, you consent to our privacy practices as outlined in the Privacy Policy.

Dispute Resolution

We encourage clients to contact us directly to resolve any concerns or disputes. If direct resolution is not possible, disputes will be resolved through mediation or arbitration as specified in individual project contracts. For consumer contracts, clients retain the right to pursue resolution through appropriate consumer protection agencies and courts.

Governing Law

These Terms of Service and all related agreements are governed by the laws of the Netherlands. Any legal proceedings arising from these terms or our services shall be subject to the exclusive jurisdiction of the Dutch courts. For consumer contracts, mandatory consumer protection laws of the European Union may also apply.

Modifications to Terms

aerflow reserves the right to modify these Terms of Service at any time. Updated terms will be posted on our website with a new effective date. Continued use of our services after modifications constitutes acceptance of the updated terms. For ongoing projects, significant changes will be communicated directly to affected clients.

Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect. The invalid provision will be replaced with a valid provision that most closely approximates the intent of the original provision.

These Terms of Service constitute the entire agreement between aerflow B.V. and clients regarding the use of our services, superseding any prior agreements or understandings. Individual project contracts may contain additional terms specific to particular renovation projects.
